Armed with the insights and recommendations provided by our firm through merit reviews, our attorney-clients can determine the best legal course of action to take (or avoid) based on the presence/absence of merit.
We perform a targeted review surrounding the date of injury/loss and let the documentation guide where to turn our attention next. Once we can determine the presence/absence of merit, we begin preparing our opinion with supporting evidence found within the medical records.
This targeted approach allows us to grant insight to our attorney-clients on how to best utilize their resources while keeping the costs for our services incredibly low. Most merit reviews take 4-6 hours to complete; however, the complexity of the case could affect our review time, but we discuss this in advance with all our attorney-clients.
Our team of Legal Forensic Nurses possess a unique combination of nursing expertise, making them well-equipped to understand complex medical concepts and able to relay those concepts in easy-to-understand language. Our knowledge of medical terminology, procedures, and practices, allowing us to efficiently navigate medical literature and extract information relevant to each case.
Our firm has access to specialized medical databases, journals, and resources that may not be readily available to our attorney-clients, facilitating quicker and more thorough research. Our medical experience, access to resources, analytical skills, and collaboration with our attorney-clients enables our team to
contribute to stronger legal arguments and more favorable outcomes for attorney-clients.
We conduct a thorough examination of all medical records to uncover important medical events and treatments linked to each client's injury. This involves analyzing diagnoses, surgeries, hospital stays, consultations, therapies, and other relevant details that could influence the outcome of the client's compensation case.
By organizing and presenting this medical evidence in a structured manner, we aim to empower our attorney-clients with the knowledge and insights they need to effectively negotiate fair settlements or present compelling arguments to a jury. This approach helps maximize the potential for recovery on behalf of each client by ensuring that their case is supported by strong and persuasive medical documentation.
Our presence at your client's exam ensures it is conducted appropriately and adheres to legal and ethical standards. Our team is trained to know they are permitted to participate or impede the exam; however, they are empowered to advocate for your client if the physician expert does not adhere to the objection parameters or if your client's rights are being violated.
Our firm provides every attorney-client a detailed report depicting all observations from our Legal Forensic Nurse Observers (LFNO) in addition to an audio recording of the exam in its entirety. Our presence helps to minimize the risk of bias or misconduct on the part of the physician expert during the examination process.
We are happy to review the physician expert report to provide medical insight and identify errors, omissions, and inconsistencies in comparison to the details within our LFNO report. Our review of the physician expert report is not provided to debate their expert medical opinion; however, the education provided in our supplemental report focuses on the accuracy of the physician expert's documented physical assessment.
In our meticulous process, we carefully examine every bill that your client receives. Our detailed billing summary reports serve as valuable tools for our attorney-clients, allowing them to precisely assess the financial consequences of the injury. This includes analyzing hospital bills, medication costs, rehabilitation expenses, and other medical treatments.
By adopting a comprehensive approach, we strive to optimize the compensation potential. This ensures that clients are adequately reimbursed for their injuries and losses, providing them with the financial support they need during challenging times.
We utilize UCR cost analysis to aid our attorney-clients in evaluating whether the medical expenses incurred by their clients are reasonable and customary within a specific geographic region or healthcare market. Through this process, we compare medical bills to UCR rates to identify any disparities or inflated charges, safeguarding clients from unjust financial burdens.
In cases where medical providers attempt to bill clients at rates surpassing UCR norms, our attorney-clients have support to contest these charges and advocate for more equitable billing practices. By referencing UCR data as a benchmark for determining fair reimbursement rates, attorneys shield their clients from potential overbilling and prevent financial exploitation stemming from their injuries.
We estimate the expenses associated with ongoing treatments, surgeries, therapies, medications, and any other necessary medical interventions following each client's injury. By projecting these costs, our attorney-clients can paint a comprehensive picture of their client's future healthcare requirements and advocate for appropriate compensation to address these needs.
Additionally, our projections assist our attorney-clients in crafting contingency plans for their clients' future requirements. They may suggest structured settlements, annuities, or other financial arrangements to ensure that clients possess the resources necessary to meet their ongoing medical and financial responsibilities. Cost projections enable attorneys to customize these plans to the individual circumstances of each client, providing reassurance and long-term stability.
We conduct a thorough audit of lien statements on behalf of our attorney-clients to pinpoint any third parties that hold a legal entitlement to reimbursement for medical expenses stemming from the injury. These lienholders assert their right to reimbursement from any settlement or judgment secured by each client.
Our audits categorize charges as relevant, irrelevant, or duplicate, simplifying the calculation of the total reimbursement obligation (or agreed-upon lien amount). Additionally, our audits aid our attorney-clients in resolving any lien disputes through negotiation or, if required, through mediation or litigation.
*Yes! We perform audits on Rawlings Lien Statements!
Life Care Planners conduct detailed assessments of an individual's current and future medical needs, considering the nature and extent of their injuries. This assessment encompasses medical treatments, therapies, medications, assistive devices, and other essential services required to address the individual's ongoing healthcare needs.
Our Life Care Planners develop customized care plans tailored to the specific needs and circumstances of each client. Each report assists our attorney-clients in negotiating fair settlements by providing expert testimony and documentation to support the projected future medical and support costs outlined in the Life Care Plan. This strengthens our attorney-client's position during negotiations and ensures that clients receive adequate compensation to cover their long-term healthcare needs.
At times our attorney-clients must rely on expert witnesses to provide specialized knowledge and insights relevant to their medical cases. Our firm provides will not only locate medical experts for our attorney-clients, but we also vet them.
We look up all professional licenses, research past offenses (if any), and speak directly with each candidate via zoom/phone call to avoid conflicts of interest, obtain fee schedules, trial availability, and ensure they are appropriate for the case at hand. This information is collected and presented to our attorney-clients in a PDF document.
Our goal is to provide our attorney-clients with 2-3 candidates, allowing them to have the final decision on the expert witness they wish to retain. We do not facilitate future communications with the expert witness once retained as expert witnesses work independently. Our services are limited to conducting the research necessary to locate and vet the expert witness candidates, providing reliable convenience for our attorney-clients.
If we cannot secure an appropriate expert witness, we will not charge our attorney-clients no matter how much was spent conducting research.
